General Terms

By using the services on the website with the domain www.gomore.dk you accept the following terms and conditions.


§1 Introduction

1.1 The operation of the website is handled by GoMore ApS, CVR-nr. 35865497, Kompagnistræde 20C, 3. sal, 1208 København K (From this point named “GoMore”)

§2 Membership

2.1 Access to the use of the services offered by GoMore, depends on whether that user is a guest or a registered member of GoMore. Guests as well as registered members of GoMore can request ridesharing by use of the GoMore platform. Access to GoMore’s communication platform’s announcement of ridesharing offers will, however, require a registered membership of GoMore.

2.2 A registered member who creates an advert for ridesharing is hereby named “Driver”. A registered member or a guest, who makes use of an advert for ridesharing is hereby named “Passenger”.

2.3 The membership of GoMore is established and is valid by:

a) The user’s accept of the terms and conditions set by GoMore;

b) The user’s correct input of user-information (name, address, phone number and e-mail address) in GoMore’s user profile, or by creating an account through their Facebook-profile. A user can at any time make changes to- or delete their user information under the menu named “account settings”. By deleting all user information, that is a condition of becoming a member of GoMore, the membership will automatically be considered as ceased.

2.4 The user will in relation to their registration on GoMore receive a confirmation e-mail to the stated e-mail address.

2.5 GoMore reserves the right to refuse or terminate any membership without consent. A user can at any given time terminate their membership without consent under the menu “Account settings”.

2.6 By signing up, the user will be registered to receive GoMore's newsletter, which will be sent to the email address associated with the user's account.

§3 Services

3.1 The users of GoMore solely acquire acces to- and usage of a communication platform (database) by GoMore. The communication platform contains and permits access to the required information needed to make it possible for Passengers to establish the necessary contact to Drivers, who advertise a ridesharing opportunity, with the expressed purpose of making an agreement on private ridesharing.

§4 Payment

4.1 Users of GoMore must follow the, at any time applicable, guidelines for pricing at GoMore unless otherwise stated. It is not allowed to agree on, or announce a different pricing. These guidelines will appear automatically when creating a ridesharing announcement.

4.2 The communication platform consists of a payment module, which provides for the possibility of online payment of ridesharing between Passenger and Driver. The concerned amount will be reserved on the Passengers debit- or credit card, when he or she books a rideshare (also named “ride”) through the use of the online payment system. The amount will be charged from the Passenger 24 hours after the planned time of departure for the concerned rideshare. The amount is transferred to the Driver’s account on gomore.dk, whereupon he or she can choose to pay out the amount.

4.3 The payment will be cancelled if the rideshare cannot completed due to the Driver’s condition, and if the Passenger informs GoMore of such through the website no later than 24 hours past the time of departure. The payment will furthermore be cancelled if the Passenger cancels the rideshare through the website no later than 24 hours prior to departure. The Passenger will be charged a cancellation fee if the rideshare is cancelled by the Passenger less than 24 hours of departure. A cancellation of a partial route by the Passenger will cause a cancellation fee unless the rideshare is cancelled no later than 24 hours prior to the time of departure of the original rideshare and not the time of departure of the concerned partial route.

4.4 GoMore reserves the right to process payment based on information from the Driver, even if the Passenger has provided timely objection. GoMore, furthermore, reserves the right to decide whether a cancellation has been made within a reasonable timeframe from the original booking and hereby cancel any payment even if the cancellation is made within 24 hours of departure. The same rules apply to cancellations completed within 3 hours of departure. Both parties will be rightfully informed via e-mail if GoMore chooses to make use of the aforementioned. GoMore can under no circumstances be held financially liable for exploitation - or lack of such - of this possibility.

4.5 GoMore charges a service fee equal to 12,5% of the price of each rideshare. The fee contributes to supporting a platform that enables communication and transactions between Drivers and Passengers. The size of the concerned service fee will be visible on the website at all times, and the Driver will automatically pay the fee from the payment, which he or she receives from the Passenger.

§5 Marketing

5.1 Direct, indirect, or any other type of advertisement from users through GoMore’s website will under no circumstances be allowed.

5.2 Any action contrary to §5.1 will be seen as a substantial violation on the agreement between GoMore and the user. GoMore reserves the right to remove any content on the website, as well as the right to take further legal action in case of violation of §5.1.

§6 User Obligations

6.1 The user confirms that any stated data is correct, and that the submission of such to GoMore does not, at any time, conflict with the current legislation or infringe on third party rights.

6.2 The user confirms that he or she, through use of GoMore, will not bring indecent- or criminal content such as virus, programs or software that can inflict software or hardware damages to GoMore or other users of the website.

6.3 The user confirms that he or she will not make any use of private data on the GoMore website, other than to provide contact directly related to GoMore’s arrangement of ridesharing or rental services. Aforementioned misuse of private data primarily refers to misuse of e-mail-addresses, private phone numbers or postal addresses, which the user may have come in possession of through use of the GoMore website.

6.4 The user confirms that he or she will use the GoMore platform in accordance with the written guidelines in these terms and conditions. GoMore reserves the right to analyse the user’s correspondences with other users in case of any suspicion of misuse. Furthermore, GoMore furthermore reserves the right to terminate the membership of the latter in case of any misuse of the platform.

§7 GoMore’s Exemption of Liability

7.1 GoMore has the sole purpose of being an intermediary that provides a communication platform and GoMore claims no further liability. Consequently, any usage of GoMore’s communication platform for ridesharing and/or rentals will be of the user’s liability. GoMore cannot be held financially liable for any damages occurring in connection with ridesharing. Likewise, GoMore can under no circumstances be held financially liable for unsuccessful and/or partially unsuccessful rideshares.

7.2 The user is in agreement with and accepts, that GoMore cannot be held liable for other users’ usage or disclosure of information on the GoMore website. Planning, execution of- and the liability of a rideshare solely depends on the Driver and the Passenger and will in no case be under the concern of GoMore.

7.3 GoMore’s service is completed when the user has received access to the available contact information, which the user has requested for the purpose of ridesharing. If the user makes use of GoMore’s online payment platform, the service will be completed when the amount is transferred from the Passenger to the Driver.

7.4 GoMore cannot be held liable for the service’s availability, errors or by reduction and/or absence of the functionality of the service, including virus, technical errors and/or outage.

7.5 GoMore cannot be held liable for financial losses or any consequential loss, including reduced income or loss of data and information.

7.6 GoMore cannot be held liable for the content on the GoMore website; including specific text, information or links entered by users in free text spaces or on the website.

§8 Data-protection

8.1 By submission of their information in regards to name, address, phone-number, e-mail-address and routine-information, the user understands and consents that all such information, as a necessary consequence of GoMore’s business concept, can be accessible to anyone using the GoMore website. Aforementioned will not apply to banking details, which will be handled confidentially.

8.2 GoMore will, as far as possible, meet the required arrangements to make sure that the user’s stated information is not accessible to other users to any further extent than necessary, in relation to GoMore’s business concept in connection with ridesharing and/or rentals. The user consents, that their user-information can be used for internal, statistical and anonymous evaluation purposes.

8.3 A user can at any time make changes to- or delete their user-information under the menu “Account settings”.

§9 Alterations of Terms and Conditions

9.1 GoMore reserves the right to make alterations in these terms and conditions.

9.2 The user will be informed via e-mail in case of alterations in these terms and conditions. Furthermore, any alteration will be visible on the GoMore website.

§10 Additional Conditions

10.1 In case one or more of the regulations in these terms and conditions become inoperative or show to be impracticable, the concerned parties are obliged to reach legal arrangements, which as far as possible come to the same- or an equivalent result.

10.2 In case one or more of the regulations in these terms and conditions is inoperative or show to be impracticable, the impracticability or the ineffectiveness will not influence the validity of other conditions.

10.3 Any dispute between GoMore and a user will settled according to Danish law.
